THE INFORMATION BESTYN COLLECTS

We may require additional information from business accounts such as licenses, approvals, and any other information/documentation that we may deem necessary.
We may also gather information about you from other sources. This may include both general and personal information (such as recent address information and more demographic information) about you from other sources (such as contractors, and business partners other third parties) to augment your account information that we have on file.
We may also gather information about others where you use our service to send messages to neighbors, including without limitation colleagues, relatives, and friends’ messages. The information we collect under such a situation may include but is not limited to such persons’ full names, email addresses, and addresses.
We may also collect some non-identifying information through our use of cookies and other technologies, including users’ IP address and browser information, language of use, and time. We may also use such cookies and/or web beacons to collect information relating to the internet, such as information about your internet service provider (ISP), referring and exit pages, browser and operating system, clickstream data, and date and time stamp.

Using Bestyn is free of charge, and we make our money by allowing businesses and organizations to pay us for showing you ads for their services and products. Your use of the Bestyn website/app in any way means that you accept our showings of ads, which we believe may be relevant to you as per your interests. You accept that our services cannot be provided and that this agreement cannot be performed without Bestyn processing data about you and other users and visitors. You also accept that the provision of personalized ads and content is very important to the provision of our Services and a core part of our agreement with you. We will, therefore, use your personal information to facilitate the conveyance of these third-party ads.
We may also use your personal information in the following ways:
To help us identify you and any user accounts that you hold with us; and to continually evaluate, improve, and advance our website/app and its services.

MINORS
People who have reached the age of 13 in the United States are welcome to use our site, but only persons who are over the age of 16 in EU countries can use the services. Bestyn is a connection platform that we have provided for neighbors to make trusted connections with each other. Our platform helps connected neighbors to exchange helpful information, services, and goods.

DEFINITIONS OF TERMS
In these terms and conditions, the following words shall be deemed to have the following meanings:

You, your, user: This shall refer to the person/entity using Bestyn’s provided services
Services: This shall refer to Bestyn’s connection services for neighbors to exchange helpful information, services, and goods.
Website/app: This shall refer to the platform through which the user is accessing and using our services
Law: This shall refer to the laws of the United States.

ELIGIBILITY
We have certain rules as per eligibility to use the services. In order to be eligible to use our services, you must:
Be 13 or older if you are resident in the United States or 16 and older if you are resident in the EU;
Have the capacity to enter into and be bound by legal documents:
Not be a registered sex offender or live on the same premises as one;
Not be barred from receiving services such as ours under relevant law;
Not have a previously-disabled Bestyn account for violations of our terms or policies.

COPYRIGHT/INTELLECTUAL PROPERTY
Except explicitly stated to the contrary, all materials, including pictures, graphics, designs, icons, video clips, written materials and all other materials found on this website/app are copyrighted, controlled, trademarked, or licensed by Bestyn or by other third parties who have licensed the materials to Bestyn. All said materials are protected by US and other international copyright laws.
Bestyn, our website/app, our logos, page headers, button icons, scripts, and service names included in or made available through Bestyn are trademarks or trade dress of Bestyn in the US and other countries.

USER ACCOUNTS
Bestyn provides an interaction service between neighbors, and will require you to register a user account in your real name, not in a pseudonym. We will ask you to provide relevant information such as your name, contact address, email address, and any other information that we may deem relevant before you are allowed to operate a user account.
You may not provide inaccurate or false registration information, or sign up to use our services where you do not meet the eligibility requirements.
We offer two different kinds of user accounts based on the need of the person(s) opening the account. We thus offer personal accounts to individual residential users; and to news media, non-profits, businesses, and other organizations. If you are signing up for a special account, we will also require you to agree to additional terms.

PAYMENT
Using Bestyn is free of charge. However, we make our money and fund our operations by allowing businesses and organizations to pay us for showing you ads for their services and products. Your use of the Bestyn website/app in any way means that you accept our showings of ads, which we believe may be relevant to you as per your interests.
You accept that our services cannot be provided and that this agreement cannot be performed without Bestyn processing data about you and other users and visitors. You also accept that the provision of personalized ads and content is very important to the provision of our services and a core part of our agreement with you.
This means that you may get notifications from Bestyn about posts from neighbors and from government agencies by default. However, you have the option of opting for other topics, after which you will then receive notifications. You may also change your choices for receiving messages from businesses or government agencies and also customize your default and opt-in neighborhood notification settings.

USER CONTENT
Where you provide any content, concept, commentaries, or information to other users or us through the use of the service, you hereby consent to Bestyn’s use of such, without any recognition that such content originated from you and without any reimbursement to you. Your provision of such user content to us means that you agree to our use of your user content for any purpose whatsoever, including without restriction for the development, creation, or marketing of products and services, and for the revision of our website/app, services or products.
You also give us the license to utilize your name, profile picture, and information about any actions taken by you on Bestyn or in connection with ads, offers, and other sponsored content that we display as per our services.
While the copyright to content submitted by you remain yours, you, however, grant us a worldwide, non-exclusive and payment-free license to use, translate, publish, dispense, alter, replicate, adjust, publicly perform and or display such content, and to use such user-generated content in any medium or format now known or later developed.

IMPORTANT RULES ABOUT YOUR INTERACTIONS WITH OTHER USERS
Be mindful of how your content and conduct affects your neighbors.
You must be fair and truthful, where you write a comment or recommendation about a transaction with a neighbor.
You must not post or share the personal information of any neighbor that becomes available to you through the website/app.
You accept responsibility for your own actions, inactions, and decisions as per any user to user transactional features that we offer through the website/app. We will not be liable for the results of such actions, inactions, or decisions that you make.
Where you and another user make the decision to work together, you both have the responsibility of ensuring that you comply with any website/applicable laws, i.e., employment or tax laws.
We will not be a party to any transaction or any dispute between users. We, however, advise that you do all you can to work out your disputes amicably. Where you cannot, you accept that we are under no circumstances to be held responsible for the actions of any user. You, therefore, release us and our managers, employees, and joint ventures from all demands, damages, and claims that may arise or be connected with such user disputes.
Where you use any text messaging service that we provide, you do so with the understanding that such a service is not meant to replace any primary phone service. While we do not charge users for sending text messages through the service, you, however, understand that you may incur charges from your carrier.

USING OUR MOBILE APP
Where you access our services through our app, we grant you a limited, rescindable, and non-transferable license to use such an app for personal use only through your Android or iOS device. You accept that additional times from the site that you downloaded the app from many also apply.

SPECIAL TERMS FOR BUSINESSES
You can register as a business on the website/app. Your business account must contain information such as business category, telephone number, street address, and a location map.
Only lawful businesses are eligible to open business pages. Business accounts differ from personal accounts, but the same eligibility requirements apply to both.
We may deactivate your business account if we are unable to confirm any information about your business that you submit when registering a business account.
You accept that business pages are public, and this means that they are visible within the Bestyn website/app and outside of the Bestyn website/app.
You may seek recommendations or reviews by other users, and where neighbors have recommended or commented on your business page, your business page may show such comments or recommendations.
You bear full responsibility for compliance with our user guidelines, as well as for all relevant laws and industry standards. This means that you will maintain all required approvals or licenses and issue required warnings or disclaimers, as required.
Where Bestyn confidential information becomes available to your business, you must keep this information confidential.

NO WARRANTY
The Bestyn website/app, software, and services are provided by us "as is.” We do not warrant that any segment of the service or software will continue uninterrupted and be error-free. We have the right to discontinue, change, or add to our product and service features, and the remedy for any dissatisfaction is to stop using the affected feature or quit using Bestyn.
Under no circumstances will we be liable to any user for any loss of profits, goodwill, sales, or business, whether these are special, punitive, consequential, or incidental damages, whether they arose out of negligence or not.
Under no circumstances shall Bestyn be liable to any user for more than $100. Where some jurisdictions do not allow the exclusion of damages as stated above, such exclusions may not website/apply to you.

INDEMNITY
You agree to indemnify and hold Bestyn, its related companies, directors, employees and agents harmless from and blameless against all liabilities, attorneys’ fees, and costs, losses, costs and other expenses as per any claims or actions brought against Bestyn as a result of any breach of these terms and conditions by you or other liabilities arising out of your use of and access to this website/app.

INVALIDITY
If any of the terms contained in this agreement is determined and adjudged to be invalid or unenforceable for any reason by a United States court of competent jurisdiction, both parties agree to severe such a term while all the remaining terms survive and continue to be binding and enforceable.

DISPUTES
Except where prohibited, you consent that any and all disputes, claims, and causes of action directly or indirectly arising out of the website/app shall be individually resolved, without resorting to any kind of class action.

JURISDICTION

WAIVER
